A New York Supreme Court judge dismissed New York City’s ambitious lawsuit against major energy companies on Tuesday, delivering a major blow to the city’s efforts to hold corporations financially accountable for climate change. The lawsuit, targeting Exxon Mobil, BP, and Shell, sought massive compensation for the alleged role these companies played in driving global warming. The case, one of many similar suits filed in Democrat-controlled jurisdictions, aimed to hold the fossil fuel industry responsible for climate-related damages.
Justice Anar Patel, in her ruling, highlighted the contradictory arguments presented by the city. She wrote that New York City couldn’t claim that its residents were both aware of the connection between fossil fuels and climate change while also alleging they were misled by the energy companies about the environmental impact of their products. “The city cannot have it both ways,” Patel stated, according to Reuters.
The court also found no evidence that the energy companies or the American Petroleum Institute had engaged in deliberate “greenwashing” to deceive consumers about their contributions to a sustainable energy future. A spokesperson for New York City’s law department expressed disappointment, stating that the lawsuit alleged these corporations spent millions convincing consumers that their products were environmentally friendly. The city is reportedly reviewing its options in response to the ruling.
Justice Patel’s decision follows a recent Supreme Court refusal to intervene in a similar climate lawsuit brought by Honolulu, signaling growing judicial skepticism toward such cases. Critics argue that these lawsuits threaten U.S. federalism and energy security by encouraging courts to legislate climate policy—a task better suited for elected lawmakers. Allowing disparate courts to impose regulations through litigation could create a chaotic and inconsistent regulatory landscape for energy production nationwide.
